When we provide a full written review of your IR35 contract, also include our tax investigation service to protect you against the costs of HMRC looking into your IR35 arrangements. We will review your contract and advise of your IR35 status, providing reasoning for our opinion based on relevant case law and scoring based on HMRC’s business entity test.
Under our tax investigation service we are able to make a claim against our insurance policy held with Professional Fee Protection (PFP) in respect of our fees and any subsequent tax liability (including tax, NIC’s, interest and penalties) incurred when we defend a client who is subject to the following events:
- IR35 Status Check – Where HMRC write asking if you fall within the scope of IR35. The indemnity limit for this is £2,000.
- IR35 Disputes – This is where HMRC state you should be subject to the IR35 legislation following a PAYE Compliance Visit or the issue of a notice under paragraph 24(1) Schedule 18 FA 1998. It will feature a disagreement over whether this legislation applies. The indemnity limit for this is £100,000.
The Main Exclusions in our Service:
- Contracts must be reviewed in advance with any amendments being made in accordance with our recommendations.
- All terms in the reviewed contract must be followed.
- Tax returns must have been submitted no later than 90 days after the statutory filing deadlines and any charges to tax notified to HMRC within required deadlines.
